It is a fact of life that employers will, sooner or later, need to carry out a formal or informal investigation into some aspect of behavior or incident at their workplace. This will be a result of a complaint or allegation about amongst others, an employee’s misconduct, poor performance, incapacity, dishonesty, safety, or health issues. Investigations may also be used to address other issues, such as absenteeism and cultural issues, employment equity, union issues, etc. in the workplace.

To investigate is to examine, inquire into, study carefully, putting the puzzle together, searching for the truth in both, the interests of justice and in accordance with the specifications of the law. In a workplace, it is the examination of facts, evidence, or events that have been left out or events to determine, assess and report on matters pertaining to workplace inability or disciplinary matters.

An investigation thus carries with it the notion:

  •  Of discovering the truth, and in doing so, in the most appropriate way.
  •  That it is a fact-finding exercise.
  • That the employer has to make a decision on how to act, once the fact-finding had been concluded.
  • That a workplace investigation is not a trial, nor is it a court case.

The investigator is required to be an impartial fact-finder, and is required to observe the rules when conducting an investigation.
This means that many of the rules applicable to criminal investigations will not apply to work place investigations.
